We at Urban Journalist B.V. may process your personal data. The term 'personal data' means all information about an identified or identifiable natural person. Urban Journalist B.V. is the party responsible for processed data within the meaning of the General Data Protection Regulation (“the GDPR”).

This Privacy and Cookie Policy applies to our website www.urbanjournalist.com (‘Website’), our online application (‘App’) all of our other services. This Privacy and Cookie policy explains how we use any of your personal information we might collect, the use of cookies and your privacy rights. Do not hesitate to contact us if you have questions. Which personal data do we process?

If you use our Website, App and/or other services, we may process your personal data, as provided by you:

• Name and address, i.e. surname, first names, initials, titles, sex, address, postcode, city;
• Other contact data, i.e. telephone number, email address and similar data required for communication;
• Location data;
• Login data, i.e. password and username;
• Favourites and other data you store in the App;
• Data on the use of our Website and App, such as duration of use.
• Your IP address, other online identifiers, and data about the device you use - smartphone, tablet, etc. - such as your MAC address;
• The operating system with which you visit our Website or App;
• Personal data you provide when communicating with us, such as the content of email messages sent to us;
• Other data requiring processing because of applicable laws or regulations, such as, under certain circumstances, the processing of certain data concerning proof of identity.

We also process personal data of persons from whom we purchase products or services or who are employed by such suppliers. This may include the following - categories of - personal data:

• Name and address data, i.e. surname, first names, initials, titles, sex address, postcode, city, as supplied by supplier;
• Other contact data, i.e. telephone number, email address and similar data required for communication as supplied by supplier;
• Data for placing orders, purchasing services; calculating and recording fees and expenses and making payments and collecting claims, including the bank account number as provided by the supplier;
• Other supplier data requiring processing because of applicable laws or regulations.

When you apply to us, we may process the following - categories of - personal data as provided by you:

• Name and address data, i.e. surname, first names, initials, titles, sex, address, postcode, city;
• Other contact data, i.e. telephone number, email address and similar data required for communication;
• Bank account number and data for travel expenses, i.e. commuting distance;
• Nationality, date of birth;
• Availability, CV and employment history, educational history, i.e. copies of diplomas, certificates, testimonials, and a cover letter;
• References, details of the position applied for, interview notes and written communication with the applicant.

When you sign up for our newsletter, we may process the following - categories of - personal data:

• Your email address;
• Whether you open the newsletter and the activity "in" the newsletter, i.e. open and click rate;
• If you open the newsletter:
  • The time the newsletter is opened;
  • your location;
  • the operating system used.

We have no intention of collecting personal data from persons under the age of 16.

 

On what basis and for what purposes do we process your personal data? 

We process your personal data if:

1. this is necessary for the execution of an agreement to which you are a party or the performance of pre-contractual acts at your request;
2. this is necessary to comply with a legal obligation;
3. this is necessary for the protection of our legitimate interests or the interests of a third party;
4. your consent has been given.

When we process your personal data on the basis of your consent, we will ask you for your consent separately. You may withdraw your consent at any time. Please note that withdrawing your consent does not affect the lawfulness of processing of your personal data before the withdrawal.

We use the above personal data for the purposes set out below, indicating for each purpose on the basis of which the above-mentioned basis (a to d) we do so. When data processing is based on the basis of 'legitimate interest', this interest will be briefly explained. Purposes with their associated bases:

• To allow you to create an account and/or profile and to provide you with the requested services (a, b, and c: to be able to offer and improve the services);
• To be able to deal with any complaints and disputes about the service (a, b, and c: to defend rights, to maintain and improve existing relationships through proper complaint handling, to improve the quality of our service);
• To keep in touch with you and to communicate with you; (a, b, c: the importance of being able to help you with questions, etc.);

• To contact our existing customers by email for marketing purposes or when you actively sign up for our newsletter (c: our legitimate interest to inform you about our promotions, events and services, d). You can unsubscribe from marketing communications at any time. With regard to existing customers, we will only bring our own products and services to your attention, provided that these products and services are comparable to the products and services you already receive and you will have the opportunity to object (for more information, see below section: "Your privacy rights");
• To provide you with access to our Website and/or App and for security purposes and to track user statistics of our Website and/or App and analyse behaviour in order to improve our Website and/or App, to tailor our services to your preferences and for our and third party advertising purposes (see below in the section on "Cookies", under "Tracking cookies") (c: the importance of providing a safe and optimized Website and App environment that is tailored to your personal preferences, d)

To whom do we provide your personal data?

We do not provide your personal data to third parties (also called ‘Recipient’ in the General Data Protection Regulation (‘the GDPR’)), unless this is necessary for the proper execution of the purposes described in this Privacy and Cookie policy, when this is legally required or when you have given your permission. The third parties to whom the personal data are made available are obliged to treat your personal data confidentially. If these parties are regarded as 'processors' within the meaning of the privacy legislation, we will ensure that a processing agreement is concluded with these parties that meets the requirements set out in the General Data Protection Regulation (“the GDPR”).

 

We can share personal data with:

• Suppliers, such as software suppliers, external – legal - counsel, accountants, etc.
• Courts and government agencies.
• Other parties, such as regulators and other agencies if required by law or with your consent.

We may transfer personal data to a recipient in a country outside the European Economic Area providing with a lower level of personal data protection than that provided by European legislation. In such a case, we will ensure that such a transfer of personal data is in compliance with  applicable laws and regulations, for example, by concluding a model contract drawn up and approved for that purpose by the European Commission, and will assess whether additional measures are necessary in order to guarantee an adequate level of protection of your personal data. Cookies

Our Website and our App use cookies, i.e. small text files, and similar techniques, hereinafter collectively called "cookies". Cookies are placed on your computer, tablet, mobile phone, or another device and are read when you use our Website and/or App to collect information about you and the device you are using. Functional cookies

The functional cookies we use are necessary for the technical operation of the Website and/or App and customer convenience. These cookies ensure that the Website and/or App works properly and remember your preferences, for instance.

Analytical cookies

In order to adapt our Website and/or App to the wishes and interests of our visitors and to offer you an enjoyable Website experience, we use analytical cookies.

We use Google Analytics from Google LLC., ("Google"). By means of Google Analytics, we gain insight into how our Website and App are used. This includes user statistics such as the number of different visitors, the pages that are visited most and the average duration of a visit. Personal data are processed for this purpose, namely your IP address, information about the device you are using - device identifiers -, cookie identifiers and client identifiers. Manual for Privacy Friendly Google Analytics Settings of the Dutch Data Protection Authority . This means, for instance, that we have instructed Google to remove the last three digits of your IP address, so that it is difficult to trace IP addresses to specific visitors, and that we have deactivated the default settings for sharing data with Google.

In addition, we have concluded a processing agreement with Google. We do not use other Google services in conjunction with the Google Analytics cookies. The limited information that is shared with Google by means of Google Analytics can be transferred and stored by Google on servers in the United States.

Tracking cookies

In addition, Facebook can place tracking cookies to track your surfing behaviour and online behaviour for advertising purposes. Your explicit permission will be requested for placement of such cookies.

Links to other Websites and social media platforms.

On the Website and/or in the App you may find links and pixels to other Websites and/or social media platforms. We are not liable for the use of personal data by the parties that provide these Websites and/or /social media platforms. Cookies remain on your computer, tablet, mobile phone, or other device for the period indicated above, unless you delete them manually. How long do we store your personal data?

We do not keep your personal data in an identifiable form longer than is necessary to achieve the purposes stated in this Privacy and Cookie Policy. Therefore, we retain your personal data for 2 years. In addition, the following specific retention periods apply:

• Personal data, which pursuant to section 52 of the Algemene wet inzake rijksbelastingen(AWR) (Dutch General Act on Taxes) must be recorded, will be kept for 7 years, from the end of the year in which the data in question lost its current relevance for the – tax – administration, because of the tax retention obligation incumbent on us pursuant to section 52(4) of the AWR;
• Personal data collected for newsletter subscriptions will be removed from our mailing list as soon as you unsubscribe from our newsletter;
• Personal data you have provided to us for your job application will be retained for four weeks after the end of the application process. Provided you have given us your  permission to do so, we will keep your personal data for one year after the end of the application process. This will allow us to approach you for any future vacancies. When you start working for us, the personal data you provided in connection with your application will become part of your personnel file;
• The retention periods for personal data obtained by means of cookie use may vary for each specific cookie. For more information about deleting cookies, see the "Cookies" section above.

The specific retention periods mentioned above can be extended if legal retention obligations apply or become applicable. We may also retain personal data for a longer period if this is necessary for the settlement of incidents and/or legal disputes.

Security

We have taken appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing and against loss, destruction, damage, modification, or disclosure. For example, we use TLS (Transport Layer Security). This means that we send your data via a secure internet connection. You can tell this by the 'https' address bar and the padlock icon in the address bar.

Your privacy rights

You have the following rights regarding to the processing of your personal data by us:

• The right to request whether we are processing personal data about you and if so, to access your personal data and certain information about the processing of your personal data;
• The right to rectification of your personal data if they are incorrect or incomplete;
• The right to have your personal data erased ('right to be forgotten’);
• the right to object to the processing of your personal data or to restrict the processing of your personal data;
• The right to withdraw consent to the processing of your personal data, if the processing is based on your consent;
• The right to receive or deliver your personal data to a third party designated by you in a structured, commonly used, and machine-readable form, i.e. 'right of data portability'.

We do not use automated decision-making in the sense of Art. 22 GDPR. If you want to exercise your rights, you can send a specified request to support@urbanjournalist.com or by regular mail to the contact details listed in the introduction to this Privacy and Cookie Policy.

In order to avoid providing information to the wrong person, we may ask for additional information to verify your identity. In principle, we will inform you within one month after receipt of your request whether we can comply with your request. This period may be extended by two months in specific cases, such as complex requests. We will inform you of such an extension no later than one month after receipt of your request. Under certain circumstances, we may refuse your request based on privacy legislation. If this is the case, we will explain why. You can find more information about your privacy rights on the Website of the Autoriteit Persoonsgegevens (the Dutch Data Protection Authority).

Complaints

If you have a complaint about our processing of your personal data, we will try to resolve it together with you. If this does not lead to the desired result, you have the right to submit a complaint to the competent supervisory authority. In the Netherlands, this is Autoriteit Persoonsgegevens (the Dutch Data Protection Authority). If you live or work in another country of the European Union, you can submit a complaint to the supervisor in that country.

Amendments

This Privacy and Cookie Policy was last amended on April 25, 2021. We reserve the right to modify this Privacy and Cookie Policy. The most recent version of this Privacy and Cookie Policy will always be posted on our Website and in our App. If there are substantial changes that could significantly affect one or more data subjects, we will strive to inform these data subjects directly.
